1. PRIVACY POLICY

  • 28Watt Trading Pty Ltd (ACN 679 586 915) (28Watt) is committed to keeping your information safe and secure. By engaging 28Watt’s services (the Services), you are giving consent to 28Watt to use the Personal Information in the manner set out in this Privacy Policy.
  • Personal Information is information we hold which is identifiable as being about a specific individual.
  • Where we use defined terms in this Privacy Policy, those terms have the same meaning given to them in our terms and conditions found on our website www.28watt.com.au (the Website), unless otherwise indicated in this Privacy Policy. 28Watt operates the Website.

2. THE SERVICES

  • The Website offers you the opportunity to be introduced to a reseller and installer (the Installer) of energy-efficiency products (Products) at your nominated property (the Property) and a financier (the Financier) to fund the purchase and/or installation of the Product at your Property (the Financing Services) (collectively referred to as the Services).
  • The Personal Information collected for the purpose of the Services will only be released insofar as it is necessary to the provision of the Services.

3. COLLECTION OF PERSONAL INFORMATION

  • 28Watt may collect and use the following kinds of information:
    • information about your use of the Services (including operating system; version and language; pages viewed while using the Services and page access times);
    • information about your personal details (including, but not limited to, name; package details; phone contact details; address information; email; date of birth; IP address; and payment information); and
    • information about the kinds of products or services that you are accessing through the Services (including the type, quantity and price range);
    • recordings, tracking and share data that is obtained from the product you purchase such as the performance of the product, the efficiency of the product, the life expectancy of the product, the energy savings, the energy output, your usage of the product and other relevant information with respect to the product.
  • Personal Information you provide may be collected from you in a variety of ways, including but not limited to when you purchase a Product from an Installer to purchase and/or install the Product or engaging a Financier to providing the Financing Services.

4. USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION

  • 28Watt may use the Personal Information to:
    • enable your access to the Services;
    • provide to you the products or services that you purchase or request as a customer;information); and
    • track usage and measure traffic statistics of the Services for internal benchmarking purposes;
    • receive and/or access information from third party providers for the provision of the Services to you such as information you provide to an Installer or Financier;
    • contact you regarding your use of the Services offered by 28Watt;
    • contact you in relation to comments, complaints, enquiries or dispute resolution;
    • market and advertise to you about other product and service offerings offered by 28Watt or its third party providers;
    • collect payments from you; and
    • communicate with third party providers or associate parties with respect to the provision of the Services.
  • 28Watt will not disclose the Personal Information you provide, unless it is required, incidental or otherwise related to the primary purpose of providing services to you or a third party for which you have consented to by engaging 28Watt’s services. However, 28Watt may disclose the Personal Information to its business partners who assist in providing services to you as a customer.

  • 28Watt in its sole discretion, may disclose the Personal Information to the extent that it is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, and in order to establish, exercise or defend its legal rights. 

  • 28Watt is not liable for how a third party uses the Personal Information if the Personal Information has been disclosed in accordance with this policy.

5. DISCLOSURE OF THE PERSONAL INFORMATION OVERSEAS

  • 28Watt may transfer Personal Information to someone who is in a foreign country where such transfer is required to facilitate the Services. We will use reasonable endeavours to ensure that that foreign country has similar privacy laws to that in Australia, and we will only transfer your data in accordance with the applicable laws in Australia.

6. SECURITY OF THE PERSONAL INFORMATION

  • It is important that you advise 28Watt of changes to any of the Personal Information that you have provided to 28Watt in your use of the Services, as it is essential that the Personal Information is accurate, complete, and up-to-date in order for 28Watt to provide the Services to you.
  • 28Watt uses reasonable technical precautions and has implemented business processes to protect the Personal Information from misuse, loss, unauthorised access, modification and disclosure. However 28Watt is not liable for any unauthorised access to, or dissemination of, this information.
  • 28Watt will take all reasonable steps to destroy or permanently de-identify Personal Information if it is no longer needed for the purposes of providing our services to you and where 28Watt is not required to retain that information by law.

7. ACCESS TO THE PERSONAL INFORMATION

  • You are responsible to ensure that the Personal Information you provide to 28Watt is accurate, complete and up-to-date.
  • By request, you may contact 28Watt at hello@28watt.com.au and ask to know what sort of Personal Information is held by 28Watt in relation to your use of the Services, for what purposes, and how it is collected, held, used and disclosed and you may also request access to the information held. 28Watt may charge, in its discretion, a reasonable administration fee for this access.

8. IDENTIFIERS AND ANONYMITY

  • You acknowledge that 28Watt may retain, collect and maintain the Personal Information for statistical analysis purposes for internal purposes, where required to do so as part of the Services or for benchmarking and reporting purposes. You agree that 28Watt may share, distribute and/or transfer information which you have provided to 28Watt to third parties, after that information has been de-identified, except for your residential address which may be included in the information that is shared, distributed and/or transferred to third parties.
  • 28Watt may use cookies on its Services. Cookies are very small files which a Services uses to identify you when you come back to the site and to store details about your use of the Services. Cookies are not malicious programs that access or damage your computer. 28Watt uses cookies to improve the experience of people using its Services. If you do not or are unable to accept cookies from 28Watt, you may not be able to access the full functionality of the Services. Cookies and applets to provide you with a better experience in using the Website, the Services and/or the Products, and it allows us to increase your security by storing your section ID so we can monitor single user access.

9. SENSITIVE INFORMATION

  • Sensitive information includes information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
  • Sensitive information will be used by 28Watt only:
    • for the primary purpose for which it was obtained;
    • for a secondary purpose that is directly related to the primary purpose;
    • with your consent; or
    • where required or authorised by law.

10. COMPLAINTS ABOUT PRIVACY

  • As a valuable customer, if you have any complaints in relation to this Privacy Policy or privacy practice, please contact 28Watt at hello@28watt.com.au.
  • A complaint should identify whether it is about:
  • the collection of Personal Information;
    • the use of Personal Information;
    • the disclosure of Personal Information;
    • the security or storage of Personal Information;
    • the accuracy of Personal Information;
    • a refusal to give access to or provide information about the Personal Information; or
    • a refusal to change or delete Personal Information.
  • 28Watt values your opinions and takes complaints very seriously. Upon receiving written notice of your complaint about privacy, 28Watt will respond quickly to advise you of the outcome following its enquiring into the same. You will also be invited to respond to its outcome. If a response is received, 28Watt will assess it and advise if it has changed its view or outcome. If you are unsatisfied with the final outcome, 28Watt will advise further options including, if appropriate, making a complaint with the Office of the Australian Information Commissioner.

11. MISCELLANEOUS 

  • No partnership or agency
    Nothing contained or implied in this Privacy Policy will create or constitute, or be deemed to create or constitute, a partnership between you and 28Watt. A party must not act, represent or hold itself out as having authority to act as the agent of the other party or in any way bind or commit the other parties to any obligation.
  • Waivers
    In limited circumstances, 28Watt may allow you to waive application of this Privacy Policy. A waiver of this Privacy Policy must be in writing and signed by 28Watt. 28Watt anticipates that the waiver of this Privacy Policy would only be in exceptional circumstances, and 28Watt encourages that you consider the circumstances leading to the waiver request prior to submitting such a request.
  • Governing Law & Jurisdiction
    This Privacy Policy is governed by the laws of the laws of New South Wales and of the Commonwealth of Australia. In the event of any dispute arising out of or in connection with this Privacy Policy, you agree that the exclusive venue for resolving any dispute shall be the laws of New South Wales and of the Commonwealth of Australia.

12. VARIATIONS TO THIS POLICY

  • This Privacy Policy is available online via www.28watt.com.au and by clicking the Privacy Policy link located in the Services. 28Watt reserves the right to modify or amend this Privacy Policy at any time and for any reason, without notification.
  • 28Watt updates this Privacy Policy from time to time by posting a new version on the Services. You shall be taken to agree to the Privacy Policy from the time the new policy is posted on the Services.
